Terms of Service

1. Who we are

AI Content Engine (the "Service") is operated by Naresh Kumar Krishnaswamy, with a registered address at Second Floor, Hauz Khas, Near Mandir, Hauz Khas Enclave, South Delhi, New Delhi - 110015("we", "us", "our"). You can contact us at support@nareshkay.com.

2. Accounts

You need an account to use the Service. You are responsible for the information you provide, for keeping your login credentials secure, and for everything that happens under your account. You must be old enough to enter a binding contract in your country, and you may not use the Service if the law bars you from doing so.

3. What the Service does

AI Content Engine helps you research content on Instagram and Facebook, analyse what performs, generate scripts and copy, produce reels, images, and carousels, and schedule and publish posts. Features vary by subscription tier and may change as we improve the product.

4. Bring your own keys (your responsibility)

The Service uses a bring-your-own-keys model. You connect your own third-party AI and media provider accounts (for example, model providers for text, image, video, and audio) by giving us their API keys. By doing so:

• You confirm you are allowed to use those keys and that you will follow each provider's own terms and usage policies.
• You are responsible for all charges those providers bill to your accounts. We do not control, mark up, or refund third-party provider costs.
• You understand that the quality, availability, and output of those providers is theirs, not ours, and can change without notice.

We store your keys encrypted and use them only to run the jobs you ask the Service to perform. See our Privacy Policy for details.

5. Acceptable use

You agree not to use the Service to:

• Break the law, or infringe anyone's intellectual property or privacy.
• Create or publish content that is illegal, hateful, deceptive, harassing, or sexually exploitative, or that impersonates others to defraud.
• Violate the terms of Instagram, Facebook, or any third-party provider you connect.
• Probe, scrape, overload, or reverse engineer the Service, or resell it without our written permission.

You own the content you create with the Service, and you are responsible for it, including making sure you have the rights to any source material, footage, music, or likeness you use.

6. Third-party platforms

Publishing and research rely on Instagram, Facebook, and other third-party services. Your use of those platforms is governed by their terms. We are not responsible for changes they make to their APIs, access rules, or availability, which can affect features at any time.

7. Billing and auto-renewal

• Subscriptions are billed in advance on a monthly or yearly basis, in Indian Rupees. Any USD figures shown are an approximate reference only.
• Your subscription renews automatically at the end of each billing period at the then-current price, unless you cancel before it renews.
• Yearly plans are charged up front for the year. Taxes may apply on top of the listed price depending on your location.
• Your subscription covers the AI Content Engine platform only. It does not cover the third-party provider costs you incur through your own keys.
• You can cancel anytime from your account. Cancellation and refund details are in our Refund and Cancellation policy.

8. Service delivery and fulfilment

AI Content Engine is a digital software service delivered online. There is no physical product and nothing is shipped. Access is granted immediately once your payment is confirmed: your plan activates on your account right away and you can start using the features included in your tier. Because it is a digital service, it is fulfilled through continued access to the platform for the period you have paid for.

9. Availability

We work to keep the Service running, but we do not guarantee it will be uninterrupted or error-free. We may carry out maintenance, change features, or suspend access where needed to protect the Service or comply with the law.

10. Suspension and termination

You may stop using the Service and cancel at any time. We may suspend or close an account that breaks these terms, creates legal risk, or abuses the Service. Where it is fair and possible, we will give you notice first.

11. Disclaimers and liability

The Service is provided "as is" and "as available". To the fullest extent allowed by law, we disclaim implied warranties and are not liable for indirect, incidental, or consequential losses, for lost profits or data, or for the cost or output of third-party providers you connect. Where we are found liable, our total liability is limited to the amount you paid us for the Service in the three months before the claim arose. Nothing here limits liability that cannot be limited under law.

12. Changes to these terms

We may update these terms as the product and the law evolve. If we make a material change, we will take reasonable steps to let you know. Continuing to use the Service after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of India, and the courts of Gurugram, Haryana, India have exclusive jurisdiction over any dispute, subject to any rights you have under mandatory local law.
